Summary: This is a study on the transfer of the management of sea beaches to
Brazilian municipalities through the Beach Management Adhesion Agreement, a
voluntary and innovative act as it transfers powers of property management to the
municipal district, the government entity closest to the population. The research
problem investigates the impacts of implementing the public policy of transferring the
management of maritime beaches along the Brazilian coast, supporting improvements
in governance and optimization of management practices. The aim is to carry out a
situational diagnosis in relation to the optimization of the governance of maritime
beaches on the Brazilian coast because of the transfer of management. The
theoretical basis looks at the National Coastal Management Plan, under which
municipalities assume responsibilities and competences in terms of coastal zoning; the
regulation of the use, occupation and management of the Brazilian coastline; the Orla
Project, which rationalizes and articulates public policies between the three levels of
government; and the law that authorizes the decentralization of beach management
and allows the transfer of ownership to municipalities. The methods and procedures
are characterized by applied research, of an exploratory nature and quantitative
approach, carried out as a multiple case study in municipalities with Terms of
Accession to Beach Management in force in 2024. Using a structured questionnaire
sent by email to Beach Utilization Managers, the data was collected and then tabulated
using Excel software. The results reveal advances and challenges in the
decentralization of Brazilian coastal governance. Among the twenty-nine participating
managers, there was a predominance of men, aged over 45, with secondary or higher
education, who were not permanent civil servants and had up to three years'
experience. Despite the difficulties, such as inadequate supervision, lack of technical
support and financial resources, most considered the term to be effective, and
highlighted improvements in infrastructure, environmental preservation and community
involvement. Based on this, two technical/technological products were developed:
the Technical Report on the Diagnosis of the Impacts of the Public Policy for the
Decentralization of Beach Management of the Term of Adhesion to Beach
Management and the List of Obligations of the Term of Adhesion to Beach
Management, for operational control of the municipalities' counterparts.
